Work permit

It is a document that entitles a foreigner to take up legal employment in Poland, provided that he has a visa or temporary residence permit allowing him to work in Poland. The permit is issued by the voivode with jurisdiction over the employer’s registered office or place of residence.
The permit indicates the entity entrusting the work to a foreigner (employer) and the position or type of work that the foreigner is supposed to perform and the minimum remuneration for it. A job is considered to be legal if the foreigner performs it at the employer’s premises and on the terms specified in the permit.

Work permit types:

  • type A – when a foreigner performs work in Poland under a contract of employment or a civil law contract with an employer who has his registered office or place of residence in Poland;
  • type B – in connection with the fulfillment by the foreigner of the function of a member of the management board of the entrepreneur entered into the National Court Register / company in an organization residing in Poland for a period exceeding 6 months in a total of 12 months;
  • type C – the foreigner performs work with a foreign employer and is delegated to Poland for a period longer than 30 days in a calendar year to Poland to work in a branch or establishment of a foreign employer or in an entity related to a foreign employer;
  • type D – a foreigner performs work with a foreign employer who does not have an organized activity in Poland and is delegated to Poland to provide an export service;
  • type E – performs work with a foreign employer and delegated to the territory of Poland for a period exceeding 3 months in the next 6 months for purposes other than those covered by type B, C, D permits.
